STATUS: Our $5,000 is frozen in escrow. SkyCoast Capital is trying to take it. We are fighting it.

Public Buyer Warning

SkyCoast Capital is trying to keep a deposit it never paid.

The seller walked away and agreed to return our earnest money. The only party trying to keep it is the wholesaler in the middle, using paperwork that falsely says we were never part of the deal.

SkyCoast Capital assigned us a purchase contract and collected our $5,000 earnest money. When problems surfaced, including a seller who missed the walkthrough, an unresolved title issue, and real inspection findings, SkyCoast didn't work to save the deal. Our counteroffer was not presented. SkyCoast went quiet. Then it invoked the deadline and claimed every dollar of our deposit. We believe what happened to us is a pattern every buyer should know about before sending SkyCoast a dime.

The $5,000 Math

SkyCoast gets paid $5,000 whether the deal closes or not.

Seller contract price

$268,657

Our assignment price

≈ $273,657

SkyCoast's assignment fee

≈ $5,000

Deposit SkyCoast is trying to keep

$5,000

If the deal closes, SkyCoast pockets $5,000. If the deal falls apart, SkyCoast tries to pocket $5,000 anyway, from the buyer. Under that structure, SkyCoast doesn't need the deal to close. It just needs the buyer's deadline to pass. We believe that structure gives SkyCoast every incentive to let deals die and keep the deposit, and that is exactly what it is attempting to do with ours.

Red Flags

What we experienced with SkyCoast Capital

01

The seller missed the walkthrough.

The seller failed to provide access for the original inspection. SkyCoast acknowledged it and agreed in writing to an extension: 'Yes extension is fine.'

02

Title wasn't confirmed clear.

Title flagged an apparent open mortgage that didn't belong to the seller. We repeatedly asked for confirmation that title was clear. It didn't come until after the scheduled closing.

03

Our counteroffer went nowhere.

After our final inspection, before the due diligence deadline passed, we gave SkyCoast our counteroffer. We were told it would not be presented to the seller.

04

Then they went dark.

While we were trying to resolve real issues, SkyCoast stopped responding. We were told they were traveling. The next thing we heard was that our deadline had passed.

05

Then they called US unresponsive.

SkyCoast claimed we were unresponsive. Our emails show we were actively communicating about title, the counteroffer, and the deposit the entire time.

06

A false statement in the termination.

SkyCoast signed an assignment naming our company as assignee. Its termination with the seller states the contract was never assigned to anyone. That statement is false.

07

The middleman wants the money.

The seller walked away and agreed to return the deposit. SkyCoast, which didn't fund it, is the only party trying to keep it.

The Paperwork

SkyCoast signed us onto this deal. Then told the seller we never existed.

The Assignment (signed by SkyCoast)

SkyCoast Capital LLC: Assignor · Our company: Assignee

SkyCoast's Termination with the Seller

“BUYER represents that it has not assigned, optioned or otherwise transferred the Contract or any interest therein to any person.”

In this document, 'BUYER' is SkyCoast.

Both documents can't be true. SkyCoast assigned the contract to us; that's on paper with its signature. Its termination says it never assigned the contract to anyone. That statement is false. SkyCoast can't have it both ways: if there was no assignment, it has no claim to a deposit our company paid. If there was an assignment, SkyCoast put a false statement in front of the seller and the title company.

Who Wants the Deposit

The seller let it go. The wholesaler won't.

When the deal ended, the seller walked away and agreed to release the earnest money back to the buyer side. The seller isn't claiming a dollar of it. No one who was actually harmed by this deal falling apart is asking for our deposit. The only party trying to take it is SkyCoast, the middleman who stood to collect the same $5,000 at closing.

The Sequence

How SkyCoast let the deal die

  1. 1SkyCoast assigns us the contract. We fund a $5,000 deposit.
  2. 2Title flags an apparent open mortgage that isn't the seller's.
  3. 3The seller misses the walkthrough. SkyCoast agrees to an extension.
  4. 4We inspect, find real issues, and give SkyCoast our counteroffer.
  5. 5We're told the counteroffer won't be presented to the seller.
  6. 6SkyCoast goes quiet. We're told they're traveling.
  7. 7SkyCoast invokes the deadline.
  8. 8Title is finally confirmed clear, after the scheduled closing.
  9. 9The seller walks away and agrees to return the deposit.
  10. 10SkyCoast claims our full $5,000 and circulates a termination falsely stating the contract was never assigned.
  11. 11The $5,000 stays frozen in escrow. We are disputing SkyCoast's claim.

Their Story

What SkyCoast says

“We missed the written termination deadline and tried to renegotiate instead of closing.”

What the record shows

We were negotiating because the seller missed the walkthrough, title wasn't confirmed clear, and the inspection turned up real issues. SkyCoast had our counteroffer and, we were told, wouldn't present it. Then it stopped responding. Then it invoked the clock. Then it told the seller the contract was never assigned and tried to keep our money. From where we sat, SkyCoast never made a real effort to save this deal. We believe it didn't need to, because it planned to collect either way.

Protect Yourself

Before you send SkyCoast Capital earnest money

  • Get written proof that every counteroffer is actually delivered to the seller.
  • Get every extension in a signed addendum, not a text or email.
  • Read who receives your deposit if the deal fails, and whether that amount matches the wholesaler's fee.
  • Ask for the seller's direct contact or the title company's confirmation of what the seller has received.
  • Read the termination paperwork before anyone signs it, and check whether it says the contract was never assigned.
  • Assume deadlines will be enforced against you even when delays are on the seller's side.

The Record

The documents

Redacted documents are added as they're prepared.

Do not give SkyCoast Capital your earnest money.

We went into this deal ready to close. We came out of it fighting a wholesaler over a deposit the seller already agreed to return. Based on everything we experienced, we would never do business with SkyCoast Capital again, and we strongly recommend you don't either. Read the record. Decide for yourself.
